Collaborative Divorce

Collaborative divorce is a divorce process that allows couples to negotiate and resolve all the terms of a divorce, without mud-slinging or fighting in court.  Couples use a team approach, supported by professionals, to address the legal, financial, and emotional aspects of divorce and reach a mutually acceptable, durable agreement.

Divorce and Custody

Divorce can be an uncertain and painful time for families.  It is vital to have access to information and legal advice to navigate the divorce process.  

Simple Wills and Powers of Attorney

A will can be an uncomfortable subject, but it is important to make sure you have a plan in place.  You can use a will to decide distribution of your belongings and assets and to identify the individual you would want to be  named guardian for minor children.  A power of attorney appoints someone you would want to make decisions for you in the event that you are unable to make those important decisions yourself.

Contracts

When entering into a contractual agreement, it is important to know what is expected of you and the other party under the terms of the agreement.  It is best to engage legal counsel on the front end to bargain for your interests and to assure that you know what you are signing. When you select Jody for your contract drafting and review, she can look out for your interests, manage your risk, and help you avoid unnecessary disputes.

Prenuptial Agreements

If you are getting married and want to protect assets and debts in the event of divorce, you may want to enter into a prenuptial agreement with your intended spouse.  The prenuptial agreement can address in advance important issues like property division, alimony, and other legal issues which must be determined in the unfortunate circumstance of divorce. 

Litigation

Jody has extensive litigation experience in a wide variety of legal issues. She works with her client to formulate strategies, identify risks, reduce dispute resolution costs, and preserve important business relationships.  Jody has represented varied businesses with a broad range of complex issues, including contract disputes, real estate disputes, product liability,  and non-compete agreements.

Personal Injury

No one ever expects to be injured in a serious accident, but it happens every day. If you or a loved one has been injured due to someone else's negligence, you may be experiencing serious physical, financial, and emotional hardships.  You may be able to seek compensation from the negligent party.  Jody brings compassion to bear in representing injured parties, including auto accident claims, slip and fall or other premises liability claims, and product liability claims.

Jody O'Brien

Attorney

Jody O'Brien has practiced law in middle Tennessee since 2001.  She has developed a broad civil practice with an emphasis on family law.  Whether representing an individual who needs the assistance of a legal professional to navigate through a difficult life event such as divorce or injury, or representing a company in a business dispute, Jody carefully advises and zealously advocates for all of her clients.

Jody founded O'Brien Law PLLC in 2012 after practicing law at Bass, Berry & Sims in Nashville for over 10 years.  Jody's past experience includes business disputes of all kinds, representation of a wide variety of manufacturers in product liability actions ranging from single cases to large, complex multi-district litigation and class actions, serving as local counsel in national pharmaceutical and medical device litigation, complex commercial disputes ranging from breach of contract and fiduciary duty, misrepresentation, and other business-related torts. She has significant e-discovery experience in connection with these matters and has managed e-discovery review teams.

Outside of the office, Jody enjoys spending time with her family and their two Siberian Huskies, foodie home cooking and baking, and traveling.

Beth Townsend

Office Manager, Paralegal

Beth Townsend came out of early retirement to join O'Brien Law in 2013 as office manager, paralegal, and administrative assistant and is an invaluable member of our team.  Beth brings a wealth of experience in legal matters, having been a partner at a family law firm for many years before retiring to focus on raising her children.  Beth brings compassion, a friendly demeanor, responsiveness, and attention to detail to serve our clients.
